Updating fees for encroachment permit applications under Legislative Code Chapter 134.

WHEREAS, Section 134.05 (c) of the Saint Paul Legislative Code provides that appropriate fees for Encroachment Permits shall be established by Council Resolution; and
WHEREAS, the fees currently in place were established on April 19, 1995 per C.F. no. 95-394, and the Public Works director reports the fee amounts are no longer adequate to cover all administrative and other costs associated with reviewing applications and issuing permits; and
WHEREAS, the Public Works director reports that administrative costs of reviewing applications must be recovered whether a permit is issued or not.
NOW, THEREFORE, be it RESOLVED, that the following non-refundable application fees shall be charged for recovery of costs associated with applications for and issuance of encroachment permits under Legislative Code Chapter 134:
A. Two hundred fifty dollars ($250.00) plus recording fees (if applicable) for applications for encroachments on public property which adjoin one, two and three family residential properties; and
B. Three hundred dollars ($300.00) plus recording fees (if applicable) for applications for encroachments on public property which adjoin all other property types; and
C. Sixty dollars ($60.00) plus recording fees (if applicable) for an application to amend a previously issued encroachment permit.
D. In addition to the fee, the applicant is responsible for any inspection costs incurred by the Department of Public Works in the course of construction of the permitted encroachment per Section 134.06(b).
The above fees shall take effect immediately upon passage and approval of this resolution.
