Appeal of David P. Allie, DC to a Re-Inspection Fire Certificate of Occupancy with Deficiencies at 1654 RICE STREET.

Purpose of Appeal: The emergency exit on the north side of my building lets out onto my neighbor's property. My neighbor is Taco Bell and their drive thru lane is right outside my emergency exit. I only own 1 foot of land on the north, south and west sides of my building. In order to put steps or a landing outside my emergency exit I would need a variance from Taco Bell. They denied my request for a variance becasue they don't want people exiting into their drive thru lane.
I have exits from the main floor going out the front (west) and rear (east) of my building that do comply as fire exits. The stairs coming down from the second floor have access to the main floor and the front and rear exits of my building.
I request that the front and rear exits of my building be considered sufficient emergency exits from my building.

WHEREAS, in the matter of Appeal of David P. Allie, DC to a Re-Inspection Fire Certificate of Occupancy with Deficiencies at 1654 RICE STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant the appeal; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
