Approving adverse action against the Auto Repair Garage and Second Hand Dealer - Motor Vehicle Parts licenses held by AAA Enterprise, Inc., d/b/a Affordable Tire at 1118 Seventh Street East.

WHEREAS, the Auto Repair Garage and Second Hand Dealer - Motor Vehicle Parts licenses held by AAA Enterprise, Inc. d/b/a Affordable Tire (License ID #20120004026) for the premises located at 1118 - 7th Street East in Saint Paul, was the subject of a Notice of Violation dated April 29, 2015, stating that during an inspection of the license premises on April 23, 2015, an Inspector from the Department of Safety and Inspections documented violations to license conditions #2, #3, #8, #9, #10, #19; and
WHEREAS, this was the second set of violations to the license conditions within the past twelve (12) months, therefore; the licensing office recommended a $1,000.00 matrix penalty per Saint Paul Legislative Code ยง 310.05 (m) (1); and
WHEREAS, the licensee did not respond to the Notice of Violation to pay the $1,000.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $1,000.00 matrix penalty or request a public or administrative hearing by May 11, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, AAA Enterprise, Inc. d/b/a Affordable Tire is hereby ordered to pay a matrix penalty of $1,000.00 for the six (6) license condition violations documented by a DSI Inspector during an inspection of the license premises on April 23, 2015.
