Pertaining to an Agreement with the City of Hugo to provide for a contribution of $30,000 towards reconstruction of a dam on the north end of Bald Eagle Lake in the city of Hugo.

WHEREAS, Minnesota Department of Transportation and the City of Hugo intend to construct S.A.P No. 224-080-002, which will remove and replace Bridge No. L8180 on 129th Street at the north outlet of Bald Eagle Lake between Elmcrest Avenue and Europa Trail in the City of Hugo; and
WHEREAS, said bridge includes a dam that controls the flow of water from Bald Eagle Lake at said north outlet; and
WHEREAS, because the condition of the Bald Eagle Lake dam impacts the water levels of Otter Lake, the Board has determined it is appropriate to make a contribution to the replacement of the dam, and to contribute towards future maintenance, only if and to the extent that it draws water from the lake; and
WHEREAS, the Board determined that a contribution of $30,000.00 towards the removal and replacement of the dam would be appropriate, as would paying for future maintenance in the event the Board draws water from Bald Eagle Lake at some future time; and
WHEREAS, the City of Hugo has prepared an Agreement for Bald Eagle Dam Repair, which addresses said contributions towards the replacement and future maintenance of the dam; and
WHEREAS, staff has reviewed and recommends approval of said Agreement, and the assistant city attorney has reviewed and approved same as to form; now, therefore, be it
RESOLVED, that the Board of Water Commissioners does hereby approve the Agreement for Bald Eagle Dam Repair between the Board and the City of Hugo, and that the proper officers are hereby authorized and directed to execute said Agreement on behalf of the Board.
