Approving adverse action against the Taxicab Driver (Provisional) license application submitted by Douglas A. Prokop.

WHEREAS, the Taxicab Driver (Provisional) license application submitted by Douglas A. Prokop (License ID #20150000779) for the City of Saint Paul was the subject of a Notice of Intent to Deny License dated April 8, 2015, stating that a check of Minnesota Department of Vehicle Services (DVS) records show the applicant was convicted on April 12, 2012 of Speed Over 100 MPH and as a result his Minnesota Driver's license was revoked for 180 days; and
WHEREAS, DVS records also show the applicant was convicted on February 23, 2012; April 25, 2012; May 10, 2012 and February 8, 2013 of Driving After Withdrawal. As a result of the fourth conviction, the applicant's Minnesota Driver's license was suspended for 365 days; and
WHEREAS, DVS records show the applicant's Minnesota Driver's license was suspended because his insurance was denied and his license was not reinstated until March 6, 2015; and
WHEREAS, based on the issues concerning the applicant's driving record, the licensing office recommended license denial per Saint Paul Legislative Code § 376.16 (e) (5) (c) and Saint Paul Legislative Code § 310.06 (b) (6) (a) and (c); and
WHEREAS, the applicant did not respond to the Notice of Intent to Deny License to request a public or administrative hearing or withdraw his license application; and
WHEREAS, the Notice of Intent to Deny License stated that if the applicant failed to request a public or administrative hearing or withdraw his license application by April 20, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Taxicab Driver (Provisional) license application submitted by Douglas A. Prokop is hereby denied.
