Approving the release of a drainage and utility easement within the property at 980 Rice Street.

 

Body

WHEREAS, Rice Street Professional Building, LLC ("Owner") owns the commercial property located at 980 Rice Street in Saint Paul (the "Property"); and

WHEREAS, Owner is planning to construct an addition to the existing building on the Property, and is engaged in the City's site plan review process; and

WHEREAS, when the Property was replatted in 2005 as "MSP Addition," drainage and utility easements were dedicated along the borders of the platted lots; and

 

WHEREAS, in order for the planned construction to proceed, portions of the drainage and utility easements must be released; and

WHEREAS, Owner is now requesting the release of said drainage and utility easements, described as:

  The west 10.00 feet and the southerly most 10.00 feet of Lot 1, Block 2,

   MSP Addition, Ramsey County, Minnesota,

and depicted in the "Easement Release Sketch" attached hereto; now, therefore be it

RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of Northern States Power d/b/a Xcel Energy - Gas Division; Northern States Power d/b/a/Xcel Energy - Electric Division; Comcast; CenturyLink; Saint Paul Regional Water Services; Verizon (MCI Network Services, Inc); Ever-Green Energy, LLC for District Energy St. Paul, Inc. & District Cooling St. Paul, Inc.; and the City's Department of Public Works - Sewer Division, the City, for itself and on behalf of said utilities, hereby waives all rights to the above-described drainage and utility easements; and be it further

 

RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificates of Intended Non-Use referenced in this resolution.
