Amending Chapter 116.05 of the Saint Paul Legislative Code pertaining to Boulevard Rain Gardens.

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
SECTION 1

Section 116.05 of the Saint Paul Legislative Code is hereby amended to read as follows:
Sec. 116.05. - Registration and right-of-way occupancy.
Each person who occupies, uses, or seeks to occupy or use, the right-of-way or any equipment or facilities located in the right-of-way, or who has, or seeks to have, equipment or facilities located in any right-of-way shall register with the department. Registration will consist of providing application information as required by the director, and payment of any registration fee.
No person may construct, install, repair, remove, relocate, or perform any other work on, or use any equipment or facility or any part thereof located in any right-of-way without first being registered with the department.
Nothing herein or in Chapter 135 shall be construed to repeal or amend the provisions of a city ordinance permitting persons to plant or maintain boulevard plantings or gardens or in the area of right-of-way between their property and the street curb. Persons planting or maintaining boulevard plantings or gardens shall not be deemed to use or occupy the right-of-way under this chapter or Chapter 135. , and Such plantings and gardens shall not be required to have obtain any permits or satisfy any other requirements for planting or maintaining such boulevard plantings or gardens under this chapter or Chapter 135.
Persons creating and maintaining boulevard rain gardens, as defined in Chapter 105, shall submit plans and information specified in Section 116.07(1), with the exception of Gopher State One-Call registration certificate number, to the department for registration and adhere to permit requirements in Chapter 135.

This Ordinance shall take effect and be in force thirty (30) days following its passage, approval and publication.
