Authorizing the Department of Parks and Recreation to enter into a joint powers agreement with the State, including an indemnification clause, to accept fishing pier components for Lake Phalen.
Body
WHEREAS, the State of Minnesota and the City of Saint Paul are authorized under Minnesota Statutes Section 471.59 to enter into agreements to jointly or cooperatively exercise common powers; and
WHEREAS, the City owns land described as Phalen Regional Park; and
WHEREAS, City has determined that providing a fishing pier on Lake Phalen (State lake ID# 62-0013-00) in Saint Paul would provide a beneficial recreational amenity; and
WHEREAS, the State will purchase the fishing pier components consisting of brackets, floats, and spud poles and provide them to the City without charge; and
WHEREAS, the joint powers agreement requires that the City indemnify the State, its agents and employees from 1) intentional, willful, or negligent acts or omissions on the part of the City; 2) actions that give rise to strict liability; or 3) breach of contract or warranty; and
WHEREAS, the City Council finds that the contribution at no cost of the fishing pier components will make it possible to provide fishing opportunities at Lake Phalen, and fulfills a public purpose; now, therefore, be it
RESOLVED, that the Saint Paul City Council authorized the appropriate City officials to enter into the attached joint powers agreement with the State.
