Approving adverse action against the Second Hand Dealer - Motor Vehicle license held by Best Buy Auto Sales, LLC, d/b/a Best Buy Auto Sales at 1414 Arcade Street.

WHEREAS, the Second Hand Dealer - Motor Vehicle license held by Best Buy Auto Sales, LLC d/b/a Best Buy Auto Sales (License ID #20100004369) for the premises located at 1414 Arcade Street in Saint Paul was the subject of a Notice of Violation dated February 2, 2015, stating that during an inspection of the license premises on February 2, 2015, a DSI Inspector found twenty-eight (28) cars parked on and outside the parking lot in violation of the approved site plan and license condition #10; and
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (1), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, licensee did respond to the Notice of Violation to admit to the facts but contest the $500.00 matrix penalty and request a public hearing which was held on March 18, 2015; now therefore be it
RESOLVED, Best Buy Auto Sales, LLC d/b/a Best Buy Auto Sales is hereby ordered to pay a matrix penalty of $500.00 for allowing twenty-eight (28) cars to be parked on and outside the parking lot in violation of the approved site plan and license condition #10.
