Approving adverse action against all licenses held by Mee Lee Moua, d/b/a Malina's Sports Bar and Grill at 691 Dale Street North.

WHEREAS, all licenses held by Mee Lee Moua d/b/a Malina's Sports Bar and Grill (License ID #20010002326) for the premises located at 691 Dale Street North in Saint Paul, were the subject of a Notice of Intent to Suspend Licenses dated January 23, 2015, stating the licensee failed to pay delinquent Liquor On Sale - 100 Seats or less license and late fees and failed to respond to Fire Inspections in order to schedule a required Certificate of Occupancy inspection; and
WHEREAS, the licensee was also sent a Notice of Violation on January 23, 2015, stating the licensee failed to provide access to video surveillance as requested by Saint Paul Police for an incident that occurred on January 9, 2015, in violation of license condition #5; and
WHEREAS, the licensing office recommended a $500.00 matrix penalty for the license condition violation; and
WHEREAS, the licensee did respond to the Notice of Intent to Suspend Licenses to contact Fire Inspection to schedule a Certificate of Occupancy inspection but failed to pay the delinquent license and late fees and the $500.00 matrix penalty; and
WHEREAS, the Notice of Intent to Suspend Licenses and Notice of Violation stated that if the licensee failed to pay the delinquent license and late fees and the additional $500.00 matrix penalty or request a hearing by February 2, 2015, that each of the matters would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, all licenses held by Mee Lee Moua d/b/a Malina's Sports Bar and Grill are hereby suspended for failure to pay delinquent Liquor On Sale - 100 Seats or less license and late fees; and
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to provide access to video surveillance as requested by Saint Paul Police in violation of license condition #5.
The licenses will remain suspended until all license, late fees and penalties are paid in full to the Department of Safety and Inspections.
