Pertaining to an Amendment No. 2 to Agreement with Bolton & Menk, Inc. to provide additional engineering services required for the design and installation of a sludge press at the McCarrons dewatering building.
Body
WHEREAS, the Board of Water Commissioners entered into an agreement with Bolton & Menk, Inc. dated November 13, 2012 to provide engineering services required for the design and installation of a sludge press at the McCarrons dewatering building at a cost not to exceed $135,320 (the "Initial Agreement"); and
WHEREAS, the Board and Bolton & Menk, Inc. entered into an Amendment No. 1 to Agreement dated July 8, 2014 that provided for additional control upgrades and rebidding of the construction contract at an amount not to exceed of $27,995, bringing the total cost of the Initial Agreement, as amended, to $163,315; and
WHEREAS, Bolton & Menk, Inc. has faithfully complied with all requirements and conditions of the Initial Agreement; and
WHEREAS, the Board and Bolton & Menk, Inc. desire to further amend the Agreement to provide panel upgrades and network changes; and
WHEREAS, staff has prepared an Amendment No. 2 to Agreement that provides for said upgrades and network changes at a cost not to exceed $16,848, which results in an amended total cost of $180,163; and
WHEREAS, staff does recommend approval of said Amendment; now, therefore, be it
RESOLVED, that Amendment No. 2 to Agreement between the Board of Water Commissioners and Bolton & Menk, Inc. to provide additional construction engineering services necessary to complete the design and installation of a sludge press at the McCarrons dewatering building at a cost not to exceed $16,848 is hereby approved in substantially the form submitted, and that the proper officers are hereby authorized to execute said Amendment on behalf of the Board following approval by the assistant city attorney.
