Pertaining to a private water main agreement with Sibley Cove Limited Partnership, Chung Hing Wong and Lan Tu Wong, and ECC White Bear Ave LLC to provide domestic water service and fire protection to 3070 White Bear Avenue North and 3094 White Bear Avenue North in the City of Maplewood.

WHEREAS, a private water main was installed in 1985 within the property addressed as 1996 County Road D East in the City of Maplewood; and
WHEREAS, an easement for water main purposes had not been properly recorded upon the property giving the Board required access rights; and
WHEREAS, the property addressed as 3070 White Bear Avenue N is currently being served by said private water main; and
WHEREAS, the developers for the property addressed as 3094 White Bear Avenue N have applied for connection to said private water main; and
WHEREAS, Sibley Cove Limited Partnership, the owners of 1996 County Road D East, are willing to provide the Board required easement rights; and
WHEREAS, Chung Hing Wong and Lan Tu Wong, the owners of 3070 White Bear Avenue N, and ECC White Bear Avenue LLC, the owners of 3094 White Bear Avenue N, are willing to assume full responsibility for the maintenance, repair, operation, and/or replacement of said private water main; and
WHEREAS, staff has prepared an agreement which provides the above described easement rights and establishes the above responsibilities of the property owners, and the assistant city attorney has reviewed and approved said agreement as to form; now, therefore, be it
RESOLVED, that the Board of Water Commissioners hereby approves the Private Water Main Agreement with Sibley Cove Limited Partnership, Chung Hing Wong and Lan Tu Wong, and ECC White Bear Ave LLC to provide domestic water service and fire protection to 3070 White Bear Avenue North and 3094 White Bear Avenue North, in the City of Maplewood, and that the proper officers of the Board are hereby authorized and directed to execute said Private Water Main A...
