Approving a request by Associated Bank to release utility easements over a portion of its property at 1533 Dayton Avenue.

WHEREAS, a request has been received from Associated Bank for the release of existing utility easements in vacated Saratoga Street (the "Easement Area"), legally described as:
All that part of vacated Saratoga Street lying between the North right-of-way line of Dayton Avenue and a straight line running from a point on the West line of Saratoga Street distant 76.25 feet North of the North line of Dayton Avenue to a point on the East line of Saratoga Street distant 47.44 feet North of the North line of Dayton Avenue;
and as defined and depicted in Ramsey County Document Numbers 1964245 and 1964246 (Abstract), and City Council File No. 268527, approved February 8, 1977; and
WHEREAS, the Saint Paul Regional Water Services, Comcast, Verizon, City of Saint Paul Public Works Department, District Energy St. Paul and CenturyLink have determined that their utility easements in the Easement Area may be released; and
WHEREAS, an easement shall be retained on behalf of Northern States Power, d/b/a Xcel Energy (Electric), for existing facilities in the Easement Area; now, therefore be it
RESOLVED, that with the accompanying Certificates of Intended Non-Use, filed voluntarily on behalf of the Saint Paul Regional Water Services for the City of Saint Paul, Comcast, Verizon, City of Saint Paul Public Works Department, District Energy St. Paul and CenturyLink, and made a part hereof by this reference, the City for itself and on behalf of said Departments and Utilities, waives all rights to the utility easements within the Easement Area; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper City officials are hereby authorized to record a certified copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles.
