WHEREAS, on July 30, 2014, John Rupp, in PED Zoning File No. 14-316-432, made application to the Saint Paul Planning Commission [“Commission”] pursuant to Leg. Code §§ 65.132 and .501for a conditional use permit in order to reuse a large residential structure for a hotel on property commonly known as 344 Summit Ave, [PIN No. 012823130056] and legally described as Dayton And Irvines Addition Ex Part Of Vac Alley Bet Lots 21 & 22 Blk 69 Desc As Fol Beg At Nw Cor Of Alley Th Sely On Wl Of Alley 202.13 Ft Th Nely At Ra 12.5ft Th Nwly Par With Sd Wl To Nl Of Alley Th Sw To Beg & Swly 35ft Of Lot 19 & All Of Lot 20 & Lo; and
WHEREAS, on August 28, 2014, the Commission’s Zoning Committee, in accordance with Leg. Code § 61.303, duly conducted a public hearing on the said application at which all persons present were given an opportunity to be heard and, at the close of the hearing and based upon all the files, reports, and testimony provided, duly recommended approval of the application; and

WHEREAS, on September 5, 2014, the Commission duly considered the matter and, following its discussion and in consideration of all the records in the matter including the reports of staff, oral testimony as substantially reflected in the minutes, and all the written testimony set forth in the record, the Commission duly moved to approve the said application subject to eight (8) specific conditions as specified in Planning Commission Resolution No. 14-57 which shall be incorporated herein by reference, based upon the following findings:
