Approving adverse action against the Taxicab Driver license held by Shane R. Swanson.

WHEREAS, the Taxicab Driver license held by Shane R. Swanson (License ID #20010000810) for the City of Saint Paul, was the subject of a Notice of Intent to Revoke License dated November 6, 2014, stating the licensee was involved in a traffic accident on October 16, 2014 while driving a taxicab for Diamond Cab; and
WHEREAS, the licensee pled guilty under a plea agreement and then convicted on October 22, 2014 of Misdemeanor Traffic-DWI-Operate a Motor Vehicle Under the Influence of Alcohol in violation of Minn. Stat. § 169A.20.1 (1) and Saint Paul Legislative Code § 376.16 (e) (5) (a) (2); and
WHEREAS, because the licensee was operating a taxicab at the time of the accident, the licensing office recommended license revocation; and
WHEREAS, the licensee did not respond to the Notice of Intent to Revoke License to request a public or administrative hearing; and
WHEREAS, the Notice of Intent to Revoke License stated that if the licensee failed to request a public or administrative hearing by November 17, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Taxicab Driver license held by Shane R. Swanson is hereby revoked.
