Approving adverse action against all licenses held by Minnesota Saloon, Inc., d/b/a Minnesota Saloon at 395 Robert Street North.

WHEREAS, all licenses held by Minnesota Saloon, Inc. d/b/a Minnesota Saloon (License ID #20120001650) for the premises located at 395 Robert Street North in Saint Paul were the subject of a Notice of Violation dated September 16, 2014, stating the licensee's security staff were involved in an altercation on July 25, 2014, with a patron outside the establishment which resulted in the patron being assaulted; and  
 
WHEREAS, the licensing office recommended a $500.00 matrix penalty and imposition of three new license conditions; and
 
WHEREAS, on September 16, 2014, a representative of the licensee attended a meeting with DSI and CAO staff to discuss the incident on July 25, 2014, the Notice and possible imposition of license conditions; and
 
WHEREAS, the representative was given a copy of the Notice and told it was sent out that day to the licensee giving him until September 26, 2014 to respond; and
WHEREAS, licensee failed to respond to the Notice of Violation to pay the $500.00 matrix penalty and return a signed affidavit agreeing to the new license conditions or request a public or administrative hearing; and
 
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty and return a signed license condition affidavit or request a public or administrative hearing by September 26, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Minnesota Saloon, Inc. d/b/a Minnesota Saloon is hereby ordered to pay a matrix penalty of $500.00 for the altercation between security staff and a patron outside the establishment which resulted in the patron being assaulted.  Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.     
 
FURTHER RESOLVED, the following conditions will be added to the license:
1.      The licensee shall maintain video surveillance cameras inside and outside the establishment.  The video recordings shall be kept by the license holder for at least thirty (30) days and shall be available for viewing by the Saint Paul Police Department immediately upon request.  In addition, if the SPPD responds to a call at the licensed premises, and due to the serious nature of the crime, requests that a copy of the surveillance footage be immediately provided, license holder shall have the technology available to make the copy at the time of the request and shall have it for the police without delay.  In other cases, if the SPPD or the Department of Safety and Inspections requests copies of the surveillance tapes, licensee shall have a 48-hour period in which to provide such copies.
2.      A camera and lighting placement plan shall be submitted to the SPPD to review for adequate coverage.  Lighting and camera placement (and number) language will be added after review by SPPD.
3.   License holder will require all employees receive training through an accredited program; this includes all employees involved in security matters.  Forward completion of this program and/or requirements to DSI as well as acknowledgement agreeing to ensure all pertinent employees, now and in the future, are compliant with such program and/or requirements.
