Waiving the $500 matrix penalty imposed by City Council on August 20, 2014 for Tiera S. Blair, d/b/a Furniture Value at 579 Dale Street North.

WHEREAS, Tiera S. Blair d/b/a Furniture Value ("Licensee") currently holds a Second Hand Dealer license (License ID #20050002115) for the premises located at 579 Dale Street North in Saint Paul; and

WHEREAS, the Second Hand Dealer license held by Licensee was the subject of a Notice of Intent to Suspend License dated July 22, 2014, stating the Licensee failed to pay delinquent license and late fees of $86.00 and submit the following information: 1) location information of where business records will be kept and/or maintained; 2) proposed hours of operation; and 3) a completed Certificate of Compliance Minnesota Workers' Compensation Law form; and

WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and

WHEREAS, according to DSI records, the Licensee did not respond to the Notice of Intent to Suspend License by the August 1, 2014 deadline to pay the delinquent license and late fees and submit required information or request a hearing; and

WHEREAS, a resolution was then submitted to the Consent Agenda on August 6, 2014, and the City Council approved license suspension and imposition of the $500.00 matrix penalty on August 20, 2014 (RES #14-1371); and
WHEREAS, on August 27, 2014, the Licensee was sent a Notice of License Suspension and Imposition of Fine letter stating she needed to pay the delinquent license and late fees of $86.00 and the $500.00 matrix penalty by September 12, 2014;

WHEREAS, DSI received a letter from the Licensee on September 12, 2014, stating she submitted the $86.00 payment and required information on July 25, 2014, and requested that the $500.00 penalty be waived; and
