Approving adverse action against the Auto Repair Garage license held by Superior Auto Repair at 1324 Arcade Street.

WHEREAS, the Auto Repair Garage license held by Superior Auto Repair d/b/a Superior Auto Repair (License ID #20120000708) for the premises located at 1324 Arcade Street in Saint Paul was the subject of a Notice of Intent to Suspend License and Notice of Violation dated July 24, 2014, stating the following: 1) the licensee failed to pay a delinquent license and late fees of $905.00 and submit required information and 2) during an inspection of the licensed premises on July 3, 2014, a DSI Inspector found a violation to license condition #1; and

WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (1), the licensing office recommended a $500.00 matrix penalty for the license condition violation and suspension of the Auto Repair Garage license for failure to pay the delinquent license and late fees and submit required information; and

WHEREAS, the amount of delinquent license and late fees were incorrectly quoted as $905.00 on the Notice when the actual amount was $474.00; and

WHEREAS, the licensee responded to the Notice of Intent to Suspend License and Notice of Violation on July 28, 2014, to pay the delinquent license and late fees of $474.00; and

WHEREAS, the check submitted by the licensee was returned to DSI as "insufficient funds", as a result, an NSF charge and additional late fees were assessed to the licensee for a current total of $633.00; and

WHEREAS, the Notice of Intent to Suspend License and Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty and delinquent license and late fees or request a hearing by August 4, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it

RESOLVED, Superior Auto Repair d/b/a Superior Auto Repair is hereby ordered to pay a matrix penalty of $500.00 for a violation to license condition ...
