RESOLVED, that upon execution and delivery of a release in full to the City of Saint Paul, the proper City officers are hereby authorized and directed to pay out of the Tort Liability Fund 10017405 - 74205 the total sum of eight hundred thousand dollars and no cents ($800,000.00) in full and final settlement of Plaintiffs' claims in Black Bear Crossings on the Lake, Inc., David Glass and Pamela Glass, civil court file number 62-CV-13-8220. Plaintiffs in their Complaint and Amended Complaint alleged that the City breached the Management Agreement between the parties and further alleged claims for defamation, declaratory judgment, specific performance and tortious interference with contract. The City has agreed to pay $250,000 to Plaintiffs within 30 days of the signing of the Settlement Agreement. The City has also agreed to pay $137,500 per year in 2015, 2016, 2017 and 2018 for a total settlement of $800,000.
