WHEREAS, in the matter of the appeal of Zach Volk, on behalf of Union Depot Lofts Association, to a Notice of Condemnation as Unfit for Human Habitation and Order to Vacate at 214 FOURTH STREET EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

WHEREAS, the Legislative Hearing Officer recommends that the City Council deny grant the appeal for use of the community room and deck upon the following conditions having been met:

1) Documents will be provided to any prospective buyer outlining the conditions
for use of the community room and deck, specifically noting its maximum occupancy load of 49;
2) Notification will be provided to all current owners and residents regarding
conditions of community room and deck;
3) Horns and strobes as part of the building fire alarm system will be installed on the exterior of the community room for notification of occupancy on deck;
4) Three signs will be posted in the community room stating total occupancy load of 49 for both the community room and deck. The signs and their location will to be determined by DSI staff;
5) A fire extinguisher will be located in the community room. Its type and location will be
determined by DSI staff; and
6) No stove will be installed in the community room.

WHEREAS, the Legislative Hearing Officer recommends that the City Council refer the matter regarding the use of the trash chute back into Legislative Hearing for October 4, for development of a recommendation on that matter; Now, Therefore, Be It
