Approving adverse action against the Cigarette/Tobacco license held by Walgreens #06995 at 1788 Old Hudson Road.

WHEREAS, the Cigarette/Tobacco license held by Walgreens #06995 d/b/a Walgreens #06995 (License ID #20020005083) for the premises located at 1788 Old Hudson Road in Saint Paul was the subject of a Notice of Intent to Suspend License dated July 21, 2014, stating that on July 7, 2014, a clerk sold Camel cigarettes to an underage person in violation of Minn. Stat. § 609.685 Subd. 1a and Saint Paul Legislative Code § 324.07 (c); and
WHEREAS, this is the third (3rd) violation for the sale of cigarettes to an underage person, within twenty-four (24) months; therefore, per Saint Paul Legislative Code § 324.11 (b)(1), the licensing office recommended an $800.00 matrix penalty and a seven (7) day suspension of their Cigarette/Tobacco license; and
WHEREAS, licensee did not respond to the Notice of Intent to Suspend License to request either a public or administrative hearing; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to request a public or administrative hearing by July 31, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Walgreens #06995 d/b/a Walgreens #06995 is hereby ordered to pay a matrix penalty of $800.00 for sale of cigarettes to an underage person on July 7, 2014. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
FURTHER RESOLVED, the Cigarette/Tobacco license held by Walgreens #06995 d/b/a Walgreens #06995 is hereby suspended for a period of seven (7) days starting at 12:00 a.m. on Wednesday, September 17, 2014 and ending on Tuesday, September 23, 2014 at 12 midnight.
