Delegating authority to the Department of Public Works to create Community Garden Agreements.
Body
WHEREAS, the City Council finds that community gardens can bring neighbors together and promote community through friendship and common work; and
WHEREAS, community gardens can provide quality freshly grown produce for our residents at a reasonable price; and
WHEREAS, the City of Saint Paul owns certain pieces of property in the city that do not have a currently specified use; and
WHEREAS, community gardens are an excellent way to temporarily use land in Saint Paul that is owned by the City but does not have a current specific use; and
WHEREAS, community groups are well situated to maintain the property surrounding the garden and the entire parcel as part of a Community Garden Agreement, thereby freeing city maintenance resources for other responsibilities; and
WHEREAS, the City of Saint Paul's Department of Public Works has successfully worked with several of the City's district councils to coordinate community gardens, and the City Council hereby determines that an efficient process should be created for Community Garden Agreements on city property under the juridiction of Public Works; now, therefore be it
RESOLVED, that the City Council delegates authority to the Department of Public Works to create Community Garden Agreements, in a form a content substantially as set forth in the Community Garden Agreement Template attached hereto as Exhibit A, for those properties the director deems suitable under the terms of this resolution, and that all said agreements be reviewed by the Office of Financial Services Real Estate Section and the Office of the City Attorney prior to their execution; and be it further
RESOLVED, that such agreements created pursuant to this resolution shall forthwith be signed by the City's finance director, city attorney and the department director.
