Approving adverse action against the Dance or Rental Halls license held by International Deli & Banquet Hall, LLC, d/b/a Farooq's Hall at 560 Como Avenue.

WHEREAS, the Dance or Rental Halls license held by International Deli & Banquet Hall, LLC d/b/a Farooq's Hall (License ID #20130003874) for the premises located at 560 Como Avenue in Saint Paul was the subject of a Notice of Violation dated June 26, 2014, stating Saint Paul Police were called to the licensed premises on June 21, 2014 due to a noise complaint and found the licensee operating after 12:00 midnight in violation of license condition #2; and
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (1), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee did respond the Notice of Violation requesting clarification of his options in late June, but then failed to follow-up with DSI to indicate whether he wanted to pay the matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a hearing by July 7, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Dance or Rental Halls license held by International Deli & Banquet Hall, LLC d/b/a Farooq's Hall is hereby ordered to pay a matrix penalty of $500.00 for operating after 12:00 midnight in violation of license condition #2. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
