WHEREAS, the Taxicab Driver license held by Abageda Tahiro Yahya (License ID #20130004566) for the City of Saint Paul was the subject of a Notice of Violation dated May 9, 2014, stating the licensee attempted to charge two passengers, one of whom appeared to be developmentally disabled, each full price for a ride they shared from the Saint Paul Amtrak Station to the Minneapolis Airport on April 25, 2014, in violation of Saint Paul Legislative Code § 376.11 (d) (f) (g) & (h); and
WHEREAS, based on this information, the licensing office recommended a $500.00 matrix penalty per Saint Paul Legislative Code § 310.05(m) (2); and
WHEREAS, licensee responded to the Notice of Violation to admit to the facts but contest the $500.00 penalty and request a public hearing which was held on June 4, 2014; now therefore be it
RESOLVED, Abageda Tahiro Yahya is hereby ordered to pay a matrix penalty of $500.00. Payment of such penalty , $250 of which shall be made within thirty (30) days of the date of adoption of this resolution.
BE IT FURTHER RESOLVED, the remaining $250.00 of the imposed matrix penalty will be stayed for 18 months given no same or similar violations.
