Approving the application with conditions, per the Deputy Legislative Hearing Officer, for Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, and Liquor - Outdoor Service Area (Sidewalk) licenses for Double Black Diamond Inc. (I.D. #20140000394), d/b/a Red Cow at 393 Selby Avenue. (Note: this is for a change in ownership of an existing location.)

WHEREAS, the Deputy Legislative Hearing Officer recommends that the application for Red Cow for a Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, Liquor - Outdoor Service Area (Sidewalk) licenses be approved with the following conditions:
1.  Sidewalk seating approved for a maximum of eighteen (18) seats.
2.  Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works. Licensee agrees to maintain the sidewalk cafĂ© in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that a failure to comply with this condition will result in adverse action being taken against all of their licenses.
3.  No outdoor food and/or beverage preparation is allowed on a public sidewalk without prior written approval from DSI.
4.  Licensee agrees to close the establishment and have all customers/patrons vacate the premises by 12:00 a.m. (midnight) each day of the week and maintain thirteen (13) off-street parking spaces on the property, to comply with the City's zoning code parking requirements.
THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon conditions.
The Conditions Affidavit was submitted on May 9, 2014.
