Body
WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and

WHEREAS, §293.09 provides for the granting of variances from the sound level limitations contained in §293.07, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and

WHEREAS, Kevin Ryan, Manager of Transitways Construction, Metropolitan Council, who has been designated as the responsible person on the application, has applied for a variance to allow Central Corridor Light Rail related work along University Avenue West from Emerald Street to Rice Street in Saint Paul; and

WHEREAS, in order to minimize disruption to University Avenue West traffic, businesses, the public and adjoining residents/property owners, the applicant is seeking a variance for the ability to work two (2) crews, one between the hours of 7:00 AM to 10:00 PM for pavement milling work and a second crew between 10:00 PM and 7:00 AM for paving (overlay) work from May 8, 2014 to May 22, 2014; and

WHEREAS, if applicant is not granted a variance, they will not be able to complete the milling and paving of University Avenue West within a timeline that would minimize disruption to traffic, businesses, the public and adjoining residents /property owners; and

WHEREAS, the Department of Safety and Inspections has reviewed the application and has made recommendations regarding conditions for the variance; now, therefore, be it
