Accepting a Storm Sewer Easement from Turning Lives Around at 1291 and 1301 Seventh Street East.

WHEREAS, on December 12, 2012 the City Council approved RES PH 12-334 vacating a portion of English Street and the adjacent alley abutting property located at 1291 and 1301 Seventh Street East, owned by 180 Degrees, Inc. ("Petitioner"); and
WHEREAS, as a condition of the vacation Petitioner was to dedicate a permanent right-of-way easement over a portion of vacated English Street and part of Petitioner's property, which dedication has since been accomplished; and
WHEREAS, as the property was improved a need arose for improved drainage of storm water from within said dedicated right-of-way, thus requiring construction of a public storm sewer from said right-of-way across Petitioner's property to an existing storm sewer line in Seventh Street East; and
WHEREAS, Petitioner, recently incorporated as Turning Lives Around, now desires to dedicate a storm sewer easement to establish property rights for the City to access and maintain said public storm sewer, and Petitioner has executed a Storm Sewer Easement, attached hereto as Exhibit A; now, therefore be it
RESOLVED, that the Council of the City of Saint Paul hereby accepts said Storm Sewer Easement and authorizes the proper city officials to record same with the Ramsey County Recorder's Office and/or Registrar of Titles.
