Approving adverse action against the Dance or Rental Halls license held by Twin Cities Dance and Entertainment, LLC, d/b/a Dancers Studio at 415 Pascal Street North.

WHEREAS, the Dance or Rental Halls license held by Twin Cities Dance and Entertainment, LLC d/b/a Dancers Studio (License ID #20100001397) for the premises located at 415 Pascal Street North in Saint Paul was the subject of a Notice of Violation dated March 17, 2014, stating that the licensee allowed her facility to be used for public dance events involving live bands and DJ's throughout the month of February, 2014, in violation of license conditions #1 & #2; and
WHEREAS, the licensee met with the Assistant City Attorney, DSI staff and Saint Paul Police on January 13, 2014, to discuss the issue of public dance events being held in her facility; and
WHEREAS, at that meeting she agreed to discontinue offering public dance events in her facility; and
 
WHEREAS, based on subsequent police reports, the licensee is still allowing her facility to be used for public dance events; therefore, per Saint Paul Legislative Code ยง 310.05 (m) (1), the licensing office recommended an $1,000.00 matrix penalty; and     
 
WHEREAS, licensee responded to the Notice of Violation to admit to the facts but contest the penalty and request a public hearing which was held on April 16, 2014; now therefore be it
 
RESOLVED, the Dance or Rental Halls license held by Twin Cities Dance and Entertainment, LLC d/b/a Dancers Studio is hereby ordered to pay a $1,000.00 matrix penalty for allowing her facility to be used for public dance events involving live bands and DJ's throughout the month of February, 2014, in violation of license conditions #1 & #2, $500.00 of which shall be made within thirty (30) days of the date of the adoption of this resolution.
 
BE IT FURTHER RESOLVED, the remaining $500.00 of the imposed matrix penalty will be stayed for 18 months given no same or similar violations.
