Approval for the Saint Paul Public Library to enter into a Use Agreement, which contains an indemnification clause, with Lumen Christi Catholic Community.
Body
WHEREAS, the Saint Paul Public Library Agency offers Summer Reading Program performances at all locations; and
WHEREAS, the Highland Park Library is closed for renovation and the Saint Paul Public Library wishes to continue to provide a Summer Reading Program to the Highland Park neighborhood; and
WHEREAS, the Lumen Christi Catholic Community will provide an appropriate space for the programs; and
WHEREAS, the parties wish to enter into the attached Use Agreement for each of the performances; and
WHEREAS, the Lumen Christi Catholic Community wishes to be indemnified in the event that any claims for any cost, damage expense, death, injury, or other casualty, caused by or arising out of the Saint Paul Public Library's use of the site while engaged in providing services through the Program, except to the extent that the damages are caused by the negligence of the Lumen Christi Catholic Community; and
WHEREAS, the Library Board finds that the provision of indemnification will enable the Library to provide the Summer Reading Program services to the Highland Park neighborhood, providing them with early literacy enrichment and skills; now, therefore, be it
RESOLVED, that the Saint Paul Public Library Agency Board authorizes the Director of the Library Agency to enter into the attached Use Agreement, which contains an indemnification clause.
