Approval for the Saint Paul Public Library to enter into a Memorandum Of Understanding, which contains an indemnification clause, with the Saint Paul Public Housing Agency

WHEREAS, the Saint Paul Public Library Agency has a Mobile Workplace Program which provides computer access, skill training, and job search and skill assistance outside of library locations, in English, Hmong, Somali, Oromo, Karen, Amharic, and Spanish; and
WHEREAS, the Saint Paul Public Housing Agency (PHA) wishes to have the Saint Paul Public Library Agency provide services through the program at various PHA sites; and
WHEREAS, parties wish to enter into the attached Memorandum of Understanding for provision of the services; and
WHEREAS, the PHA wishes to be indemnified in the event that any claims for any cost, damage expense, death, injury, or other casualty, caused by or arising out of the Saint Paul Public Library's use of the computer sites while engaged in providing services through the Program, except to the extent that the damages are caused by the negligence of the PHA; and
WHEREAS, the Library Board finds that the provision of indemnification will enable the Library to provide the Mobile Workplace Program services to the PHA tenants, providing them with valuable skills training and job search assistance for individuals with barriers to transportation and that assisting residents towards self-sufficiency serves a public purpose; now, therefore, be it
RESOLVED, that the Saint Paul Public Library Agency Board authorizes the Director of the Library Agency to enter into the attached Memorandum Of Understanding, which contains an indemnification clause.
