Approving adverse action against the Tanning Facility license application submitted by Phoenix Acquisitions, Inc., d/b/a Perfect Tan at 2180 Marshall Avenue.
Body
WHEREAS, the Tanning Facility license application submitted by Phoenix Acquisitions, Inc. d/b/a Perfect Tan (License ID #20130001542) for the premises located at 2180 Marshall Avenue in Saint Paul was the subject of a Notice of Intent to Deny License dated November 14, 2013, stating the licensee's application was pending since April 2, 2013, due to his failure to schedule a DSI Environmental Health Inspection and submit required information to continue the application process; and
WHEREAS, the licensee did respond to the Notice of Intent to Deny License on November 25, 2013, to indicate that he would contact DSI to schedule the DSI Environmental Health Inspection; and
WHEREAS, on December 9, 2013, a DSI Inspector came to the premises for an inspection, but noted the licensee still needed to provide additional Plan and sanitizing agent information; and
WHEREAS, the licensee failed to follow-up after the inspection to provide additional Plan and sanitizing agent information, a valid Minnesota Sales Tax Identification number and a signed lease; and
WHEREAS, the Notice of Intent to Deny License stated that if the licensee failed to provide the required information, request a hearing or withdraw his license application by November 25, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Tanning Facility license application submitted by Phoenix Acquisitions, Inc. d/b/a Perfect Tan is hereby denied.
