Approving adverse action against the Second Hand Dealer - Motor Vehicle license application submitted by Buy Right Auto Group, LLC, d/b/a Brag Auto Sales at 1205 University Avenue West.

WHEREAS, the Second Hand Dealer - Motor Vehicle license application submitted by Buy Right Auto Group, LLC d/b/a Brag Auto Sales (License ID #20130005287) for the premises located at 1205 University Avenue West in Saint Paul was the subject of a Notice of Intent to Deny License dated January 10, 2014, stating the licensee was convicted on October 3, 2005 for Felony Transportation of Person to Engage in Prostitution (18 U.S.C. Section 2421) in U.S. District Court; and
WHEREAS, further investigation found at the time of his license application on November 22, 2013, the licensee had shown no proof that he completed his supervised release, and he appeared to have violated the terms of his supervised release by failing to report contact with law enforcement and reporting vehicles driven or owned by him; and
WHEREAS, based on this information, the licensing office recommended license denial per Saint Paul Legislative Code ยง 310.06 (b) (10); and
WHEREAS, the licensee did respond to DSI regarding the Notice of Intent to Deny License to state he planned to withdraw his license application; and
WHEREAS, the licensee failed to subsequently submit a request to withdraw his license application; and
WHEREAS, the Notice of Intent to Deny License stated that if the licensee failed to request a public or administrative hearing or withdraw his license application by January 20, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Second Hand Dealer - Motor Vehicle license application submitted by Buy Right Auto Group, LLC d/b/a Brag Auto Sales is hereby denied.
