Approving adverse action against the Taxicab Driver (Provisional) license application submitted by Lawrence J. Selb.

WHEREAS, the Taxicab Driver (Provisional) license application submitted by Lawrence J. Selb (License ID #0011427) for the City of Saint Paul was the subject of a Notice of Intent to Deny License dated January 9, 2014, stating the licensee was convicted on August 18, 2006 of Felony Drugs - 5th Degree- Possess Schedule 1,2,3,4 - Not Small Amount of Marijuana (Minn. Stat. § 152.025.2 (1)) in Wright County;
WHEREAS, the licensee was also convicted on August 18, 2006 of Gross Misdemeanor Traffic DWI - Operate Motor Vehicle Under Influence of Controlled Substance (Minn. Stat. § 169A.20.1 (2)) in Wright County; and
WHEREAS, further investigation found at the time of his license application on December 18, 2013, the licensee had been discharged from probation for two these convictions on August 2, 2011 and August 4, 2011 respectively; and
WHEREAS, based on this information, the licensing office recommended license denial per Saint Paul Legislative Code § 376.16 (e) (4) (a) and § 376.16 (e) (5) (a) (2); and
WHEREAS, the licensee did not respond to the Notice of Intent to Deny License to request a public or administrative hearing or withdraw his license application; and
WHEREAS, the Notice of Intent to Deny License stated that if the licensee failed to request a public or administrative hearing or withdraw his license application by January 20, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Taxicab Driver (Provisional) application submitted by Lawrence J. Selb is hereby denied.
