Approving adverse action against the Tree Trimmer & 1 Vehicle license held by Richard D. Cook, d/b/a Green Tree & Stump.

WHEREAS, the Tree Trimmer & 1 Vehicle license held by Richard D. Cook d/b/a Green Tree & Stump (License ID #20080002858) for the City of Saint Paul, was the subject of a Notice of Intent to Suspend License dated December 18, 2013, stating the licensee failed to pay delinquent license and late fees of $267.00, have his vehicle inspected, and submit the following information: 1) current vehicle information, 2) a current certificate of General Liability insurance, 3) proof of registration with the Commissioner of Agriculture, 4) proof of an ISA Certified Arborist on staff and 5) a completed Certificate of Compliance Minnesota Workers' Compensation Law form; and
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, the licensee did respond to the Notice of Intent to Suspend License to pay the delinquent license and late fees, have his vehicle inspected and submit all the required information except proof of an ISA Certified Arborist on staff; and
WHEREAS, DSI sent the licensee a letter on January 10, 2014 requesting proof of an ISA Certified Arborist on staff but the letter was returned with a new address; and
WHEREAS, DSI resent the letter to the new address on January 17, 2104, and has not received a response from the licensee regarding the an ISA Certified Arborist on staff; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to submit all the required information or request a hearing by December 30, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
