Approving adverse action against the Cigarette/Tobacco license held by Til B. Pokwal Chhetri, d/b/a Himalayan Grocery, Inc. at 1423 Rice Street.

WHEREAS, the Cigarette/Tobacco license held by Til B. Pokwal Chhetri d/b/a Himalayan Grocery, Inc. (License ID #20130002010) for the premises located at 1423 Rice Street in Saint Paul was the subject of a Notice of Violation dated December 30, 2013, alleging that on December 23, 2013, a clerk sold tobacco products to an underage person in violation of Minn. Stat. § 609.685 Subd. 1a and Saint Paul Legislative Code § 324.07 (c); and
WHEREAS, this was the third violation within one year regarding the sale of cigarettes to an underage person; and
WHEREAS, per Saint Paul Legislative Code § 324.11 (b) (1), the licensing office recommended an $800.00 matrix penalty and a seven day suspension of their Cigarette/Tobacco license; and
WHEREAS, licensee did respond to the Notice of Violation to request a public which was held on February 5, 2014; now therefore be it
RESOLVED, Til B. Pokwal Chhetri d/b/a Himalayan Grocery, Inc. is hereby ordered to pay a matrix penalty of $800.00 for the third violation for the sale of cigarettes to an underage person within one year. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
FURTHER RESOLVED, the Cigarette/Tobacco license held by Til B. Pokwal Chhetri d/b/a Himalayan Grocery, Inc. is hereby suspended for a period of seven days. Said suspension will begin at 12:00 a.m. Wednesday, February 26, 2014 until 11:59 p.m., Tuesday, March 4, 2014.
