Approving adverse action against Auto Repair Garage and Auto Body Repair Shop licenses held by Ivo Fru Tabukum, d/b/a IT Auto Towing & Services at 33 Acker Street.
Body
WHEREAS, the Auto Repair Garage and Auto Body Repair Shop licenses held by Ivo Fru Tabukum d/b/a IT Auto Towing & Services (License ID #20130002927) for the premises located at 33 Acker Street in Saint Paul were the subject of a Notice of Violation dated December 3, 2013, alleging the licensee failed to correct the two (2) license conditions violations documented by a DSI Senior Inspector after a re-inspection on November 26, 2013; and
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (2), the licensing office recommended a $500.00 matrix penalty;
WHEREAS, the licensee did respond the Notice of Violation on December 20, 2013 and was given an extension until December 31, 2013, to bring his premises into compliance; and
WHEREAS, an inspector from the Department of Safety and Inspections conducted a re-inspection of the premises on January 13, 2014, and counted twenty-six (26) cars on the lot when license condition #1 only allows seventeen (17); and
WHEREAS, the inspector also observed cars parked in areas of the lot outside the approved site plan in violation of license condition #2; and
WHEREAS, licensee failed to respond to the Notice of Violation to pay the $500.00 matrix penalty or request a hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a hearing by December 13, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that Ivo Fru Tabukum d/b/a IT Auto Towing & Services is hereby ordered to pay a matrix penalty of $500.00 for failure to correct the two (2) license condition violations documented by a DSI Inspector after re-inspections on November 26, 2013 and January 13, 2014.
