Approving adverse action against the Cigarette/Tobacco license held by Renaissance Marketing, LLC, d/b/a Corner Gas at 304 Larpenteur Avenue East.

WHEREAS, the Cigarette/Tobacco license held by Renaissance Marketing, LLC d/b/a Corner Gas (License ID #20100002670) for the premises located at 304 Larpenteur Avenue East in Saint Paul was the subject of a Notice of Violation dated December 30, 2013, alleging that on December 23, 2013, a clerk sold Swisher Sweets cigarettes to an underage person in violation of Minn. Stat. § 609.685 Subd. 1a and Saint Paul Legislative Code § 324.07 (c); and
WHEREAS, this was the third violation within one (1) year for the sale of cigarettes to an underage person, so per Saint Paul Legislative Code § 324.11 (b) (1), the licensing office recommended an $800.00 matrix penalty and a seven (7) day suspension of their Cigarette/Tobacco license; and
WHEREAS, licensee did not respond to the Notice of Violation to request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to request a public or administrative hearing by January 9, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Renaissance Marketing, LLC d/b/a Corner Gas is hereby ordered to pay a matrix penalty of $800.00 for the third (3rd) violation for sale of cigarettes to an underage person within one year. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
FURTHER RESOLVED, the Cigarette/Tobacco license held by Renaissance Marketing, LLC d/b/a Corner Gas is hereby suspended for a period of seven (7) days. Said suspension will begin at 12:00 a.m. Wednesday, February 25, 2014 until 11:59 p.m., Tuesday, March 4, 2014.
