Diverting parkland and declaring permanent easement at Payne and Maryland.

Body
WHEREAS, the City of Saint Paul (“City”) and Ramsey County (“County”) have entered into a cooperative agreement (“Agreement”) for the Payne Maryland Project to reconstruct and rebuild the intersection of Maryland Avenue at Payne Avenue to add left turn lanes on Maryland Avenue, attached hereto as Exhibit A; and
WHEREAS, the City has acquired, and is fee title owner of the Kendall Hardware site, formerly 1200 Payne Avenue, for right of way purposes, and per the agreement, the County will reimburse the City for half of the acquisition cost, including purchase price, relocation, and demolition and the City will declare an easement for right of way purposes over the northerly portion of 1763 square feet that will accommodate the County turn lane project; and
WHEREAS, the City will retain the remnant of the Kendall hardware site of 10,205 square feet and declare it as parkland which will be become part of the Arlington Hills Community Center; and
WHEREAS, the County has requested the parkland diversion and will pay just compensation for 4296 square feet of existing City parkland over the former Arlington Recreation Center site that will also be declared by the City as a permanent easement for right of way purposes for the County turn lane project as depicted in Exhibit B; and
WHEREAS, the Saint Paul Parks and Recreation Commission recommends diversion of the said parkland, as stated in its resolution #13-18 and supports dedicating an additional 10,205 square feet of the said remnant land to compensate for the parkland to be diverted as depicted in Exhibit C; now, therefore be it
RESOLVED, that the Mayor and City Council hereby authorizes and directs the diversion of said parkland to create a permanent right of way easement, and that the proper city officials are authorized and directed to declare a permanent easement for right of way purposes over that portion of the former Ken...
