Title

Authorizing the Department of Parks and Recreation to enter into a management agreement with Prom Management for the management services of Phalen and Como Golf Courses.

Body

WHEREAS,   the City Council authorized the Department of Parks and Recreation to issue a Request for Proposals for Management services for Phalen and Como Golf Courses pursuant to Saint Paul Administrative Code §85.06(c); and

WHEREAS,  a Request for Proposals was issued and the City selected Prom Management Group as the successful vendor; and

WHEREAS,  the Department of Parks and Recreation has negotiated a Management Agreement with Prom Management which has a longer term than that permitted by the provisions of §85.09(3); and

WHEREAS,  the proposal submitted by Prom Management requested a longer contract term in order to justify the monetary investments in the two golf courses, and the Department of Parks and Recreation reasonably believes that the two year term is too restrictive to allow a profitable contract for management services of the courses; and

WHEREAS,  the Department has requested a waiver of the contract term provision under Saint Paul Administrative Code §85.13 and requests that the Saint Paul City Council approve the Management Agreement with Prom Management Group which  has a term of five years; and

WHEREAS, the Agreement contains termination provisions in the event that the Manager does not meet the revenue payments or fails to meet performance standards, which will protect the City in the event that the Agreement needs to be terminated earlier than the five years; and

WHEREAS,  the Saint Paul City Council has reviewed the Management Agreement which has been negotiated between the Department of Parks and Recreation and Prom Management Group and finds that the scope and content of the managed competition request for proposal was adequate, now, therefore, be it
