In the matter of approving the petition of 1601 University, LLC ("Petitioner") to specially assess the costs of constructing, reconstructing, altering, extending, operating, maintaining and promoting the fire protection system at 1601 University Avenue West.
WHEREAS, in the interest of public safety and subject to the requirements of law, the City of Saint Paul is authorized by Minnesota Statutes, Chapter 429, to specially assess the costs ofconstructing, reconstructing, altering, extending, operating, maintaining and promoting the fire protection systems in existing buildings; and
WHEREAS, the City Council accordingly adopted Council File No. 88-481, and amended by Council File No. 97-67, to establish requirements and procedures for the construction of fire protection systems as public improvements to be assessed to benefitting properties; and
WHEREAS, the Petitioner has agreed to the requirements and procedures by signing the attached agreement and waiver; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby approve said petition and authorize that the above-described improvement be made; and be it further
RESOLVED, that upon the completion of said improvement, the proper City officers shall calculate all expenses incurred therein and shall report the same to the City Council in accordance with Chapter 14 of the City Charter.
