Approving adverse action against the Sidewalk Café license held by Shish A Mediterranean Grill & Café, Inc. at 1668 Grand Avenue.
Body
WHEREAS, the Sidewalk Café license held by Shish A Mediterranean Grill & Café, Inc. d/b/a Shish A Mediterranean Grill & Café (License ID #20060000017) for the premises located at 1668 Grand Avenue in Saint Paul, was the subject of a Notice of Intent to Suspend License dated November 5, 2013, alleging licensee failed to pay $33.00 for the Sidewalk Café license and submit a current certificate of General Liability insurance; and
WHEREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, the licensee did respond to the Notice of Intent to Suspend License on November 20, 2013 stating she would come to DSI to pay the delinquent Sidewalk Cafe license fee and submit a current certificate of General Liability insurance; and
WHEREAS, the licensee failed to follow-up after the telephone conversation to pay the delinquent Sidewalk Cafe license fee and submit a current certificate of General Liability insurance; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the delinquent Sidewalk Cafe license fee and submit a current certificate of General Liability insurance or request a hearing by November 18, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Sidewalk Café license held by Shish A Mediterranean Grill & Café, Inc. d/b/a Shish A Mediterranean Grill & Café is hereby suspended for failure to pay the delinquent license fee of $33.00.
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit a current certificate of General Liability insurance in order to maintain the license.
