Approving adverse action against the Cigarette/Tobacco license and Alarm Permit (New) held by St. Paul Tobacco Room, LLC, d/b/a St. Paul Tobacco Room at 152 University Avenue West.

WHEREAS, the Cigarette/Tobacco license and Alarm Permit (New) held by St. Paul Tobacco Room, LLC d/b/a St. Paul Tobacco Room (License ID #20120005673) for the premises located at 152 University Avenue West in Saint Paul, was the subject of a Notice of Intent to Revoke License dated November 4, 2013, stating that on October 2, 2013, the licensee was sent a letter by the Department of Safety and Inspections (DSI) regarding the fact that the Fire Certificate of Occupancy for the building had been revoked; and
WHEREAS, the licensing office recommended revocation of all licenses and permits, per Saint Paul Legislative Code ยง 40.01(a), which requires that "all existing buildings in the city are required to have and maintain a fire certificate of occupancy, issued by the fire marshal"; and
WHEREAS, the licensee did not respond to the Notice of Intent to Revoke License to request a public or administrative hearing; and
WHEREAS, the Notice of Intent to Revoke License stated that if the licensee failed to request a public or administrative hearing by November 15, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Cigarette/Tobacco license and Alarm Permit (New) held by St. Paul Tobacco Room, LLC d/b/a St. Paul Tobacco Room are hereby revoked.
