Title

Authorizing the City of Saint Paul, Parks and Recreation Department, to enter into a grant agreement with and provide indemnification for the State of Minnesota, Department of Transportation, to accept a $799,880 FHWA High Priority grant for the Bruce Vento Trail, and to amend the budget to include additional monies. 

 

Body

WHEREAS, on some City of Saint Paul transportation related projects, the City finances either whole or in part with federal funding; and

 

WHEREAS, under the Minnesota Statutes Section 161.36, the City desires the Commissioner of Transportation be appointed as the City’s agent in accepting federal aid funds made available for preliminary engineering of a trail connection between the existing Bruce Vento Regional Trail and the existing Mississippi River Corridor; and

 

WHEREAS, the MnDOT Grant Agreement contains a requirement that the City indemnify MnDOT against any claims or costs including actions related to the certification of DBE participation; and

 

WHEREAS,  acceptance of the federal funds will allow the project to proceed and the project will benefit the public by preparing the trail connection project for bid opening, and the trail connection project itself will add to the recreational opportunities for Saint Paul; and

 

WHEREAS, the Department of Parks and Recreation would like to amend the 2013 Capital Budget to reflect the full amount of the FHWA funding available for this project; now, therefore, be it

 

RESOLVED, that the proper city officials are authorized to enter into MnDOT Grant Agreement #04556, which includes an indemnification clause, and any amendments to the agreement; and, be it

 

FURTHER RESOLVED, by the City Council of the City of Saint Paul, upon recommendation of the Mayor and advice of the Long Range Capital Improvement Budget Committee, that $799,880 is available for appropriation in the 2013, and said 2013 budget, as heretofore adopted by the Council, is hereby further amended.
