Accepting a permanent flood control easement from the Saint Paul Port Authority at the Authority's Barge Terminal No. 2 site.
 
Body
WHEREAS, the City of Saint Paul Public Works Department ("City") has requested a permanent flood control easement ("Easement") on property owned by the Port Authority of the City of Saint Paul ("Port Authority") at the Barge Terminal No. 2 ("BT-2 site") to establish a 15-foot buffer extending from the toe of the slope of the City's flood control levee along the southerly edge of the BT-2 site; said easement would allow the City to access, maintain and repair the levee; and
 
WHEREAS, the Port Authority has agreed to grant said Easement to the City, as described and depicted in the Dedication of Easement and survey drawing attached hereto as Exhibit A; now, therefore be it
 
RESOLVED, that the Council of the City of Saint Paul does hereby accept said Easement on behalf of the City of Saint Paul, in a form and content substantially as set forth in Exhibit A attached hereto, and authorizes and directs the proper city officials to record same with the Ramsey County Recorder's Office and/or Registrar of Titles.
