Approving adverse action against all licenses held by Richard A. DeFoe, d/b/a Wilebski's Blues Saloon at 1638 Rice Street.

WHEREAS, all licenses held by Richard A. DeFoe d/b/a Wilebski's Blues Saloon (License ID #0096027) for the premises located at 1638 Rice Street in Saint Paul were the subject of a Notice of Violation dated September 26, 2013, alleging the licensee allowed patrons to remain in the licensed establishment after 1:30 a.m. without currently holding a 2AM closing license with the State of Minnesota and the City of Saint Paul; and   
 
WHEREAS, the licensing office recommended a $500.00 matrix and require that the licensee either discontinues operating after 1:30 a.m. or obtain the appropriate 2AM closing license; and
WHEREAS, licensee did respond to the Notice of Violation to obtain the 2AM closing license with the State of Minnesota and the City of Saint Paul but failed to pay the $500.00 matrix penalty or request a public or administrative hearing; and
 
WHEREAS, on October 14, 2013, a follow-up letter was sent to the licensee acknowledging that he obtained the appropriate 2AM closing license but failed to pay the $500.00 matrix penalty; and
WHEREAS, the licensee did not respond to the follow-up letter to pay the $500.00 matrix penalty by the October 21, 2013 deadline; and
 
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a public or administrative hearing by October 7, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Richard A. DeFoe d/b/a Wilebski's Blues Saloon is hereby ordered to pay a $500.00 matrix penalty for allowing patrons to remain in the establishment after 1:30 a.m. without holding the appropriate 2AM closing license.
