Approving adverse action against all licenses held by Budget Towing, Inc. of St. Paul at 560 Randolph Avenue.

WHEREAS, all licenses held by Budget Towing, Inc. of St. Paul d/b/a Budget Towing, Inc. of St. Paul (License ID #20120005762) for the premises located at 560 Randolph Avenue in Saint Paul were the subject of a Notice of Violation dated October 3, 2013, stating the Department of Safety and Inspections received a complaint regarding a tow truck driver charging a pickup owner a $150.00 towing fee despite the fact that the vehicle had not been hooked up to the tow truck; and
WHEREAS, the tow truck driver would not move his vehicle until the $150.00 towing fee was paid and then refused to give the pickup owner a copy of the receipt showing his payment in violation of Saint Paul Legislative Code § 361.07; and
WHEREAS, the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, licensee did not respond to the Notice of Violation to pay the $500.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a public or administrative hearing by October 14, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Budget Towing, Inc. of St. Paul d/b/a Budget Towing, Inc. of St. Paul is hereby ordered to pay a matrix penalty of $500.00 matrix penalty for charging a towing fee for a vehicle that had not been hooked up to the tow truck and refusing to give the owner a receipt showing his payment in violation of Saint Paul Legislative Code § 361.07.
