WHEREAS, the City has identified environmental investigation and clean-up projects within the City that meet the purposes and criteria of the Contamination Cleanup Grant Program of the Department of Employment and Economic Development and the Tax Base Revitalization Account Grant Program of the Metropolitan Council; and
WHEREAS, the City of Saint Paul, Minnesota is a participant in the Livable Communities Act's Housing Incentives Program for 2013 as determined by the Metropolitan Council, and is  therefore eligible to make application for funds under its Tax Base Revitalization Account; and
 
WHEREAS, the City finds that the required contamination cleanup will not occur through private  or other public investment within the reasonably foreseeable future without funding from the Contamination Cleanup Grant Program and/or the Tax Base Revitalization Account Grant Program; and
 
WHEREAS, the City represents that it has undertaken reasonable and good faith efforts to procure funding for the activities for which Contamination Cleanup Grant Program funding and Tax Base Revitalization Account Grant Program funding is sought but was not able to find or secure from other sources funding that is necessary for cleanup completion and states that this representation is based on the following reasons and supporting facts:
·      State reductions in Local Government Aid leave the City of Saint Paul with no general fund resources to invest in remediation activities, and
·      The State limits on tax increment financing, the expiration of some tax increment districts, and the depletion of various development accounts leave the Housing and Redevelopment Authority of the City of Saint Paul with no development resources to invest in these remediation activities.
WHEREAS, the City has the institutional, managerial, and financial capability to ensure adequate project and grant administration; and
WHEREAS, the City certifies that it will comply with all applicable laws and regulations as stated in the contract grant agreements;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Saint Paul, Minnesota hereby approves the contamination investigation and cleanup grant applications submitted to the Department of Employment and Economic Development and the Metropolitan Council on November 1, 2013; and
BE IT FURTHER RESOLVED, that the City of Saint Paul, Minnesota agrees to act as legal sponsor for the projects contained in the cleanup grant applications submitted to the Department of Employment and Economic Development and the Metropolitan Council on November 1,  2013,  and  that  the  Director  of  the  Department  of  Planning  and  Economic Development is hereby authorized to apply to these agencies for funding of these projects on behalf of:
·      Aurora St. Anthony Limited, LLC for the Western University Plaza project,
·      Ironton Management, LLC for the Custom House project,
·      Educational Properties TCGIS, LLC for the German Immersion School,
·      All, Inc. for the Gross-Given Manufacturing site,
·  Sherman and Associates with Rayette Apartments, LLC for the Rayette site,
·      The Housing and Redevelopment Authority of the City of Saint Paul for the Rice and Sycamore project; and
BE IT FURTHER RESOLVED, that the sources and amounts of the local match identified in the applications are committed to the projects identified; and
BE IT FURTHER RESOLVED, the City certifies that it has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest, or other unlawful or corrupt practice and that it will comply with all applicable laws and regulations as stated in the contract agreements; and
BE IT FURTHER RESOLVED, that if the City is awarded a grant by the Department of Employment and Economic Development and/or the Metropolitan Council, the City of Saint Paul
will be the grantee and agrees to act as legal sponsor to administer and be responsible for grant funds expended for the project contained in the Contamination Investigation and Cleanup grants and the Tax Base Revitalization Account grants submitted on November 1, 2013;
NOW THEREFORE BE IT FINALLY RESOLVED, that the Mayor and City Clerk of the City of Saint Paul are hereby authorized to execute such agreements as are necessary to implement the projects on behalf of the applicant.
