Amending File Nos. RLH AR 13-52 and RLH TA 13-325, adopted by Council to Ratify the Appealed Special Tax Assessment for Real Estate Project No. J1309A, Assessment No. 138521 at 726 RANDOLPH AVENUE.

WHEREAS on July 10, 2013, the City Council of the City of Saint Paul adopted File Nos. RLH AR 13-52 and RLH TA 13-325, said Resolutions being the Ratification of Assessment for Property Clean Up Services from March 4 to 27, 2013. (File No. J1309A, Assessment No. 138521); and
WHEREAS, the property at 726 Randolph Avenue, being described as: Scheffers Addtion W 3 Ft Of Lot 6 And Ex W 2 Ft Lot 7 Blk 2, with the property identification number 11-28-23-41-0038 was assessed an amount of $320.00; and
WHEREAS, the Legislative Hearing Officer recommends ratifying the assessment and payable in one installment;
WHEREAS, an invoice was sent to Keith Eklund for payment of assessment;
WHEREAS, Keith Eklund indicated he contacted the office prior to the Council date and stated he wanted to reschedule his public hearing date and this did not happened;
WHEREAS, a Legislative Hearing was conducted on October 1, 2013 and the file was reviewed;
WHEREAS, Legislative Hearing Officer's recommendation is to delete the assessment as the owner is not responsible for snow removal for the Bay Street side of the property and good faith effort was made on his sidewalk; Now, Therefore, Be It
RESOLVED, that the assessment be deleted, plus any accrued interests.
