Amending Legislative Code Chapter 64.750 pertaining to the Highland Village Special Sign District.

STATEMENT OF FINDINGS BY THE COUNCIL
WHEREAS, the Highland Village Special District Sign Plan was originally adopted in 1985 under the provisions of Leg. Code § 64.601 for special district sign plans; and
WHEREAS, the Highland District Council and Highland Business Association, in 2012, proposed amendments to the Highland Village Special District Sign Plan; and
WHEREAS, Leg. Code § 64.601 requires changes to special district sign plans to be approved by City Council resolution, after review and recommendation by the Planning Commission, and after public hearings before both the Planning Commission and the City Council; and
WHEREAS, on December 14, 2012, the Planning Commission duly conducted a public hearing on the amendments proposed for the Highland Village Special District Sign Plan where all interested parties were afforded an opportunity to be heard; and
WHEREAS, based upon the testimony and recommendations received during the December 14, 2012 public hearing, staff subsequently prepared revised draft amendments for the Highland Village Special District Sign Plan and, in a memorandum dated February 13, 2013, the Planning Commission's Comprehensive Planning Committee submitted these revised draft amendments to the Commission for action along with the memorandum and its rationale for making the proposed amendments,; and
WHEREAS, on February 22, 2013, the Planning Commission reviewed and duly moved to forward the proposed amendments to the Highland Village Special District Sign Plan, together with the accompanying memorandum, to the City Council for the purpose of conducting the required public hearing on the proposed changes to the Highland Village Special District Sign Plan; and
WHEREAS, the City Council, having duly conducted a public hearing on November 20, 2013 at which all interested parties were given an opportunity to be heard, the Council, having considered all the testimony and recommendations concerning the amendments proposed for the Highland Village Special District Sign Plan, and in consideration of the memorandum of February 13, 2013 in which an extensive rationale for the recommended amendments to the Sign Plan is set forth and which the Council finds persuasive and so hereby incorporates the memorandum by reference into this ordinance for the specific purpose of articulating the Council's reasons and rationale for enacting the amendments to the Sign Plan as fully set forth under Council File No. 86-1451, as amended by Resolution 13-1405 in addition to any other reasons the Council might articulate on the record in adopting this ordinance:
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
SECTION 1
Legislative Code Chapter 64, Article IV, 64.600, Special Sign Districts, is hereby amended as follows:
Sec. 64.750. Highland Village special district sign plan.
The Highland Village special sign district plan, created as provided in section 64.601, pursuant to city council resolution C.F. NO. 86-1451, applies to the area along Ford Parkway between Mississippi River Boulevard and Snelling Avenue, and along Cleveland Avenue between Randolph Avenue and Villard Avenue, as shown on the official zoning map of the Highland Village special sign district accompanying this code. as defined by said council resolution. The provisions of this plan are supplementary to those of this chapter and the most restrictive provision shall apply. Within the Highland Village special district sign plan, signs shall be subject to the provisions as contained and set forth in city council resolution C. F. No. 86-1451 as amended. The zoning administrator shall enforce the provisions of the Highland Village special district sign plan as a supplement to this chapter of the zoning code, and the most restrictive provision shall apply. Whenever a permit for a sign within the Highland Village special sign district is required under the provisions of this chapter, such permit shall not be issued unless the plans for the sign have been approved by the zoning administrator as in conformance with the Highland Village special district sign plan. Building permits applications for signs in the Highland Village special sign district shall be submitted to the zoning administrator for review and approval.
SECTION 2
This Ordinance shall take effect and be in force thirty (30) days following its passage, approval, and publication.
