Approving adverse action against the Malt Off Sale and Cigarette/Tobacco license applications submitted by Piassa, LLC, d/b/a Piassa Market at 512 North Snelling Avenue.

WHEREAS, the Malt Off Sale and Cigarette/Tobacco license applications submitted by Piassa, LLC d/b/a Piassa Market (License ID #20130003553) for the premises located at 512 North Snelling Avenue in Saint Paul were the subject of a Notice of Intent to Deny Licenses dated August 26, 2013, stating the applicant was convicted on January 14, 2013 in Ramsey County District Court of Misdemeanor Attempt Receiving Stolen Property (Attempt to Commit) in violation of Minn. Stat. § 609.53.1; and
WHEREAS, on August 15, 2013, an inspector from the Department of Safety and Inspections observed cigarettes displayed behind the counter and cans of beer in the cooler;
WHEREAS, the applicant's Malt Off Sale and Cigarette/Tobacco licenses are currently pending with DSI; therefore, the applicant is operating without obtaining the appropriate licenses; and
WHEREAS, per Saint Paul Legislative Code § 310.06 (b) (6) (a), the licensing office recommended a denial of the licenses; and
WHEREAS, licensee did respond to the Notice of Intent to Deny Licenses to request a public hearing which was held on October 16, 2013, now therefore it be
RESOLVED, the Malt Off Sale and Cigarette/Tobacco license applications submitted by Piassa, LLC d/b/a Piassa Market are denied.
This resolution, and action taken above, is based upon facts contained in the August 26, 2013, Notice of Intent to Deny Licenses sent to the licensee and the arguments made at the public hearing on October 16, 2013.
